What changed for freight brokers in 2026?
On May 14, 2026, the Supreme Court ruled 9-0 in Montgomery v. Caribe Transport II that federal law does not block state claims against a broker for negligently selecting an unsafe carrier. The ruling lets those claims go forward; it did not find any broker liable.
Since January 16, 2026, the FMCSA broker bond and trust rules are fully in force: if the $75,000 bond or trust falls short, the broker's authority can be suspended. The bond protects the people you owe money. It is not liability insurance.
